Peruta v San Diego
1. The Federal Court of Appeal for the 9th Circuit decided the Peruta v San Diego Case early last year. In many respects, it was a landmark decision. Interestingly, the opinion has been followed by other districts and, of course, not by others. The decision was appealed (no surprise) by the State of California and has been briefed thoroughly. Due to the enormous interest in the outcome of the case, the Court has set up a special website which is open to the public. Contained within this site are the briefs that have been filed as well as the courts original decision. Of special interest, I strongly recommend that you read the decision of 2/13/14.
